Petition of Bethany Ponniah: Allow Suppression of Victim Sexual History

Petition request

That the House of Representatives pass legislation to allow complainants the right to automatic suppression of sexual history used as evidence in criminal cases that do not fit the requirements of section 44 of the Evidence Act 2006 unless the Judge deems it necessary for the evidence to be public knowledge.

Petition reason

I feel that public availability of sexual history fails to protect victims, creates undue hardship on the victim of an offence, and directly or indirectly affects the complainant, which negates the purpose of criminal proceedings for victims and can cause revictimisation. I believe the courts have a duty to protect victims where possible, and that reporting of the murder of Grace Millane has focused on the victim’s sexual history instead of the crime, causing unnecessary hardship on the family.
