Petition of Shane Fisher-Van Der Veen: Change the Dog Control Act rules about destruction of an animal

Published date: 11 Aug 2020

Petition request

That the House of Representatives change section 57 of the Dog Control Act 1996 that states that the court must make an order for the destruction of the dog in the case of attack on persons or animals unless in exceptional circumstances

Petition reason

I think a judge should be able to review each case as it is put to them, not have their hands tied by the wording of the law. My dog has been ruled by a judge to be destroyed for a few minor accidents at my property. She is not a vicious dog and I believe that both judges at the District and High Courts would have stopped this destruction of my dog and had her rehomed if they were able to but the wording of the law doesn't give them enough choice to look at a case by case basis.
